The Company makes no warranty with respect to the Products, express or implied, of merchantability, fitness for a particular purpose or otherwise, except that the Product sold by the Company shall conform to the Company’s standard specifications and shall otherwise comply with any written warranty contained in the product literature provided by the Company with each item of the Product. All parts of this Product are fully covered under a Limited Lifetime warranty with the exception of Remote Controls, LCD Pagers and system Backup Batteries, which are covered by a Two-year warranty. Term of Two-year warranty for Remote Controls, LCD Pagers and system Backup Batteries will begin from date of manufacture unless manufacturer is provided with a completed warranty card accompanied with copy of purchase receipt. A completed warranty card accompanied with copy of purchase receipt will insure a two-year warranty from date of purchase. Batteries contained within Remote Controls and LCD Pagers are covered under a 12-month warranty from date of manufacture for no cost replacement. Product must be installed by an authorized installer for the installation to be covered by the warranty. The Company assumes no risk whatsoever as to the result of the
use of the products purchased.

The Company’s liability for any loss or claim including any claim for breach of any warranty, including the warranty of merchantability , if applicable, shall be limited solely to the replacement of defective or non-conforming Products or, at the election of the Company, the return of the Product and repayment of the purchase price. The Company shall not be liable for any special, incidental or consequential damages. The Distributor shall be liable to the Company for any Product which is damaged after title and risk of loss passed to the Distributor or for any Product to which Distributor made changes in fabrication, assembly or otherwise.

Any course of dealing between the Company and any third party not withstanding, any claim with respect to defective or non-conforming Products shall be deemed waived unless presented in writing to the Company promptly upon discovery of the basis therefore in any event within not more than one year after date of receipt of the Product by Distributor if the claim is made by Distributor, or if the claim is made by a consumer, within such period of time as may be stated in any warranty provided with the product literature distributed with such Product.
